Recommendation: PREAMBLE:

- The investigation revealed that the Flight Crew of D-AICD should have acted according to the SOP at the initial TA ‘’TRAFIC-TRAFIC’’ and subsequent RA “MAITAIN V/S” proposed manoeuvre by TCAS and during the TCAS escalation that resulted in the DUAL SIDE STICK INPUT.

- With the selection of ROSE mode before take-off, the intruder would have been displayed on ND during initial climb before the right turn.

SAFETY RECOMMENDATION 2021-11:

a. CONDOR FLUGDIENST GmbH to consider improving the efficiency of the Flight Crew members when performing Simulator training TCAS manoeuvres and to emphasize the importance of the SOP regarding ‘Takeover of control’ process.

b. Consider, when in VFR departures and a turn of more than 70 degrees after take off, PF and PM to select ROSE mode on the ND instead of ARC. As such, an early detection of other traffics will be achieved.

Response: The CONDOR airline’s first response to the AAIASB safety recommendation 2021-11 was received by two (2) e-mails on 15/12/2021 which received the AAIASB incoming document numbers: 2819/15.12.2021 & 2820/15.12.2021.

[INITIAL RESPONSE OF CONDOR airline]: “The first SAFREC [Safety Recommendation] 2021/11a) has been accepted, as we had the same SAFREC [Safety Recommendation] internally. The implementation was in 2018/2019 during the simulator sessions for all pilots. See the attachment for details [attachment provided with details on SR actions and mandatory TCAS Training].

The second SAFREC [Safety Recommendation], 2021/11 b), has been implemented partly, as we prohibited visual departures at KVA [KAVALA] at all. We will give you an update of the possible implementation about the EFIS control selection (ARC/ROSE) during visual departures in the next few days [Attachment Provided regarding applied Restriction on visual departures at Kavala airport due to high risk index in Risk Assessment as an immediate action to decrease the risk of a similar event].”

[AAIASB assessed this response on 20-01-2022 (document AAIASB/161/20.01.2022) as "Partially Adequate" and kept the SR 2021-11 status to "Open" stating that prohibiting visual departures at Kavala (KVA) airport does not solve the safety issue regarding the use of ROSE mode at other airports]

[INTERMEDIATE RESPONSE for AAIASB SR 2021-11b on 02/3/2022]: “Our Flight Crew Training Manual (FCTM) will be updated, inserting that the ROSE MODE shall be selected when flying a visual departure. The Operations Manual A (OM-A) will be update das well.

Furthermore, we added a visual departure in PMI [Palma de Mallorca Airport] out of runway 06R (Passing 3.000ft, right turn inbound MJV [Waypont] ) in our Simulator Refresher Program for the summer season. This is under approval at the LBA [Federal Aviation Office].

We will pass you a copy of the approval from the LBA [Federal Aviation Office] to complete the SAFREC [Safety Recommendation] documentation.

[AAIASB assessed the response as "Partially Adequate" and kept the SR 2021-11 status to "Open" until documented implementation]

We hope, this response satisfies your recommendations.”

“Furthermore the LBA [Federal Aviation Office] approved the new SIM Refresher Syllabus [Simulator Refresher Syllabus], which is attached here as well [Attached documents are not made publicly available by AAIASB]. During the training, we are practicing a visual departure at LEPA [Palma de Mallorca Airport], relating to the new procedure to use ROSE MODE.”

[AAIASB assessed this response as “Adequate” on 07/4/2022 (Board meeting) and changed the SR 2021-11 status to “Closed”]
